Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Hooky (“we”, “us”, “our”), operator of Hooky Generator(the “Service”). By accessing or using the Service you agree to be bound by these Terms and our Privacy Policy, Refund Policy, and Acceptable Use Policy.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you represent that you meet this requirement and have the legal authority to enter into these Terms.

Hooky Generator provides AI-powered image enhancement tools, including background removal, AI upscaling, and studio relighting. The Service is delivered as a web application and is intended for use with product photography you own or have a valid licence to process.

We may update, improve, or modify the Service at any time. We will make reasonable efforts to communicate material changes in advance.

• You are responsible for keeping your account credentials secure.
• You must provide accurate information and keep it up to date.
• You are responsible for all activity that occurs under your account.
• One person or legal entity per account, unless we agree otherwise in writing.

The Service is sold as one-time credit packs. Each credit corresponds to one image enhancement. Credits do not expire unless explicitly stated at the time of purchase.

All payments are processed by Stripe, Inc. (“Stripe”). By making a purchase you also agree to Stripe's Services Agreement. We do not store full payment card details on our servers.

Prices are displayed in U.S. dollars unless otherwise indicated. You are responsible for any taxes, duties, or levies that may apply in your jurisdiction. Refunds are governed by our Refund Policy.

We reserve the right to refuse, cancel, or suspend any order if we suspect fraud, abuse, or violation of these Terms.

You retain all ownership rights in the images and materials you upload to the Service (“Your Content”). By uploading content, you grant us a worldwide, non-exclusive, royalty-free licence to host, process, transform, and display Your Content for the limited purpose of providing the Service to you.

You represent and warrant that you own or have all necessary rights to Your Content, and that processing Your Content through the Service will not violate any law or any third party's rights (including copyright, trademark, privacy, or publicity rights).

Uploaded images are automatically deleted from our processing infrastructure within 24 hours of completion. See our Privacy Policy for more detail.

To the extent permitted by applicable law and subject to your compliance with these Terms, we assign to you all of our right, title, and interest (if any) in the AI-generated output produced from Your Content (“Output”). You may use the Output for personal or commercial purposes.

You acknowledge that the Service uses machine-learning models and that identical or substantially similar Output may be generated for other users using similar inputs. We make no representation that any Output is unique or free of similarity to other works.

You are solely responsible for the use of the Output and for ensuring that such use complies with all applicable laws, including consumer protection, advertising, and intellectual property laws.

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Upload content that infringes any third party's rights, contains malware, depicts minors in a sexualised manner, or otherwise violates our Acceptable Use Policy.
• Reverse engineer, decompile, or attempt to extract the source code or underlying models of the Service.
• Resell, sublicense, or provide the Service to third parties without our written consent.
• Use automated means to access the Service except through documented APIs.
• Use the Service to build or train a competing AI model.

You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law, or to protect the Service or other users. In the event of termination for cause, unused credits may be forfeited; in good-faith terminations, we will refund the value of any unused credits to your original payment method.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING (BUT NOT LIMITED TO) MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OPERATION. WE DO NOT GUARANTEE ANY SPECIFIC RESULT FROM AI PROCESSING.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US$100), WHICHEVER IS GREATER.

IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

You agree to indemnify and hold harmless Hooky, its affiliates, officers, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising out of your use of the Service, Your Content, or your breach of these Terms.

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the “Last updated” date. Material changes will be notified by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

These Terms are governed by the laws of Stripe SaaS, without regard to conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the courts located in Stripe SaaS for any dispute that is not subject to mandatory consumer protection rules in your country of residence.
